Disorderly Conduct: New York City’s Catchall Disposition

In New York City, about 1 in 5 prosecuted cases and 1 in 3 convicted cases end in conviction for disorderly conduct.

CJA’s latest publication, “Disorderly Conduct—New York City’s Catchall Disposition,” explores the causes and consequences of this disposition practice.

Here are some of the key findings:

  • Disorderly conduct is used as a catchall disposition for cases arraigned on a variety of offense charge types and severities.
  • A defendant’s prior contact with the criminal justice system is strongly associated with disorderly conduct convictions.
  • More than 1 in 4 defendants convicted of disorderly conduct received a sentence of imprisonment.
